Terms of Service

These Terms of Service ("Terms") govern your access to and use of Ocupado ("Ocupado", "we", "our"), a property-management software platform operated by Autom84You. By creating an account or using the service, you agree to these Terms.

1. Accounts

• You must be 18 or older to create an account.
• You are responsible for all activity under your account. Keep credentials secure.
• You agree to provide accurate information and to keep it current.

2. Plan and billing

• The Landlord plan is $500 USD per month, billed via Stripe. A 14-day free trial is available.
• You may cancel at any time; access continues until the end of the current billing period.
• Tenant accounts are free.
• Rent payments from tenants to landlords are processed via Stripe Connect. Stripe charges its standard card-processing fees (currently 2.9% + $0.30). Ocupado collects an additional platform fee disclosed at the time of payment.

3. Our role as a technology platform

Ocupado provides software to help landlords, property managers, employees, maintenance workers, and tenants coordinate. Ocupado is not a party to any lease, tenancy, landlord-tenant relationship, or real-estate transaction. We do not provide legal, tax, or financial advice. AI-generated outputs (including lease-compliance scores, suggested clauses, and drafted communications) are for convenience only and do not constitute legal advice. Consult a qualified attorney before relying on any such output.

4. User content

You retain ownership of the content you upload (leases, documents, photos, messages). You grant Ocupado a limited license to host, process, and display that content solely to operate the service on your behalf.

5. Prohibited uses

See our Acceptable Use Policy. Violations may result in suspension or termination without refund.

6. Third-party services

Ocupado integrates with Stripe, Seam (smart-lock API), Anthropic (Claude API), and Zoho (email delivery). Your use of the service is subject to those providers' terms where applicable.

7. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by law, Ocupado's aggregate liability to you for any claim arising out of or related to the service shall not exceed the amounts you paid to Ocupado in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Ocupado, Autom84You, and their affiliates from any claim arising out of your use of the service, your content, or your violation of these Terms.

10. Termination

You may close your account at any time. We may suspend or terminate access for violations of these Terms, non-payment, or to comply with law.

11. Changes

We may update these Terms from time to time. Material changes will be communicated by email to the address on your account. Continued use after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of laws principles.
